By accessing or using RePhotos services, you agree to be bound by these Terms and Conditions. These terms govern your use of our real estate photography, videography, and related media services.

1. Services
REPhotos provides professional real estate photography, videography, aerial drone services, 3D virtual tours (Matterport), floor plans, and related media services. All services are subject to availability and scheduling. We reserve the right to modify our service offerings at any time.
2. Booking & Scheduling
Our standard service hours are 8:00 AM to 8:00 PM, every day except statutory holidays. We require a minimum of 48 hours notice for cancellations or rescheduling. Short-notice cancellations are subject to a $50 CAD rescheduling fee. Same-day or holiday appointments incur a $50 CAD rush fee. If access cannot be gained upon arrival, a $50 CAD no-show fee plus travel fees may apply.
3. Property Preparation
Properties are photographed "as is." Clients are responsible for ensuring properties are photo-ready before appointments. For a complete preparation guide, visit rephotos.ca/photo-day. Pets must be removed or contained, and all occupants should vacate during the session for best results.
4. Payment Terms
Payment is due upon receipt of invoice or within 7 days of service. We accept credit/debit cards, Interac e-Transfer, and cash. Late payments (over 30 days) may incur additional fees. All prices are in CAD and subject to 13% HST.
5. Travel Fees
Travel fees apply for properties outside our standard service area, calculated as: (Round trip km − 30) × $0.65. Travel fees are confirmed with clients before appointments.
6. Deliverables & Turnaround
Standard turnaround is 24 hours for photography and floor plans, and 48-72 hours for videography, video tours, and 3D virtual tours. Friday/weekend appointments are typically delivered by Monday at 5:00 PM. Rush delivery is available for an additional fee. Please download and save your files upon receipt.
7. Virtual Tour Hosting
Matterport 3D virtual tours are hosted free for 3 months from activation. After this period, a monthly hosting fee of $25 CAD applies. Tours are archived within one week after the property sells.
8. Usage Rights & Licensing
Upon full payment, you receive a non-exclusive, non-transferable license to use the delivered media for marketing the specific property while it is actively listed. Permitted uses include MLS, social media, print materials, and websites. The license expires when the property sells or is no longer listed by you. REPhotos retains full copyright ownership of all media produced.
9. Prohibited Use
Media may not be shared with, sold to, or used by third parties (including stagers, builders, buyers, or other agents) without written consent. Media must not be re-edited or modified. Unauthorized use may result in penalties under the Canadian Copyright Act ($500–$20,000 per violation).
10. Drone & Aerial Services
All drone operations comply with Transport Canada regulations. Drone services are weather-dependent and cannot be performed in rain, snow, or high winds. If conditions prevent drone services, that portion will be refunded or rescheduled at no charge.
11. Reshoots & Quality
If media does not meet our professional standards due to technical issues, we will reshoot at no charge (notify us within 3 business days). Client-requested reshoots (property not ready, staging changes, etc.) are subject to a minimum $100 CAD return visit fee plus travel.
12. Liability & Disclaimers
Services and media are provided "as is." REPhotos is not responsible for property appearance, staging, or third-party platform issues. Our liability is limited to the amount paid for services or an opportunity to reshoot. We are not liable for delays caused by circumstances beyond our control.
13. Privacy Policy
We collect personal information solely to provide our services. Your data is stored securely in Canada and is not sold or shared with third parties except as required to deliver services. You may request access to, correction of, or deletion of your information at any time.
14. Modifications to Terms
We reserve the right to update these Terms and Conditions at any time without prior notice. Changes are effective immediately upon posting. Continued use of our services constitutes acceptance of modified terms.
